Federal Drug Crime Lawyer

When Does a Drug Crime Become a Federal Offense?

Florida has laws against drug trafficking, possession, and possession with the intent to distribute. But the federal government has priority to bring charges in certain situations, such as:

  • The controlled substance was moved across state lines or national borders
  • The controlled substance transaction took place on federal property
  • The sale, distribution, manufacture, or transport involved offenders from multiple states
  • Offenders used the US Postal Service or other interstate transportation

Federal Drug Possession

Holding a small amount of a controlled substance is considered simple possession. Federal drug possession carries a penalty of up to one year in prison and a fine of $1,000. A second conviction can result in up to two years in prison and a fine of $2,5000. These penalties are similar to Florida state simple possession offenses.

Drug Trafficking

Drug trafficking is the manufacture, sale, distribution, or transportation of a large quantity of a controlled substance. Drug trafficking is a much more serious crime than simple possession. The penalties for trafficking are based on the type and quantity of controlled substance. Examples include:

Mandatory minimum five years in prison, up to 40 years in prison:

  • Cocaine (Schedule II)—500-4999 gram mixture
  • Fentanyl (Schedule I)—40-399 gram mixture
  • Heroin (Schedule I)—100-999 gram mixture
  • LSD (Schedule I)—1-9 gram mixture
  • Methamphetamine (Schedule II)—5-49 gram mixture
  • PCP (Schedule II)—100-999 gram mixture

Mandatory minimum 10 years in prison, up to life in prison:

  • Cocaine (Schedule II)—5 kilogram mixture or more
  • Fentanyl (Schedule IV)—400 gram mixture or more
  • Heroin (Schedule I)—1 kilogram mixture or more
  • LSD (Schedule I)—10 gram mixture or more
  • Methamphetamine (Schedule II)—500 gram mixture or more
  • PCP (Schedule II)—1 kilogram mixture or more
