American Dream Mall Faces Lawsuit Overstuffed Animal Ride

A woman has filed a lawsuit against the American Dream Mall in East Rutherford, New Jersey after she says she was seriously injured on a riding stuffed animal attraction. The ride allows individual riders to sit on top of vehicles shaped like animals and ride through certain areas of the mall. The elderly plaintiff is suing the mega-mall and ride operator alleging that she was struck and seriously injured by one of the mechanized stuffed animals.

The mammoth entertainment complex features an indoor ski slope, a 300-foot Ferris wheel with dramatic views of Manhattan, an ice-skating rink, an amusement park with roller coasters and other rides, and an indoor water park.

Elements of negligence 

In the latest lawsuit filed against the American Dream Mall, the plaintiff contends that the mall and the operators of the stuffed animal rides (called Dream Riders) failed to follow any discernible safety protocols to protect the plaintiff and other patrons from injury. For example, there is no cordoned-off area for those on the Dream Riders to use the rides without potentially interacting with other patrons who are walking on their own two feet.

As a result of this negligence, the lawsuit states, the plaintiff sustained injuries to her spine and had to undergo surgery to repair the damage. She is seeking damages for “conscious pain and suffering, physical disability, emotional trauma, loss of enjoyment of life, and economic loss,” according to the lawsuit.

The suit directly makes mention of the fact that the ride operator, the mall, and its owners failed to provide a specified area where mall patrons could walk without potentially interacting with people riding the Dream Riders.

In addition to the aforementioned allegations, the plaintiff alleges that there were children using the Dream Riders and that these children were not adequately supervised. Those operating the Dream Riders did so at a “dangerous and excessive speed,” according to the lawsuit. According to the plaintiff’s attorney, the Dream Riders can move faster than an average individual can walk.

Analyzing the allegations 

The plaintiff holds that the defendant is negligent for failing to safely secure the area around the Dream Riders so that the public was protected from individuals who were riding them around. In this case, an elderly woman was struck by a Dream Rider and sustained an injury serious enough to require surgery. The mall has a duty of care to ensure that the ride is safe for both those using the Dream Riders and those in their general vicinity. In this case, their failure to adequately secure the area led to a serious injury.
